General Terms and Conditions of sale & use of Gift boxes

These General Terms and Conditions of sale and use of Gift boxes (hereinafter “T&C”) apply to sales of Gift cards and Gift boxes, in Euros, in France and abroad, by Millésime.

The Gift cards and Gift boxes are produced by the BIRD company, defined below as “Millésime”, whose contact details are:

They apply to sales by telephone, email, post, on site or online via the website (the “Website”).

I . / Definitions

The terms defined hereafter have the following meanings in these T&C:

Beneficiary : means the person using the Gift card.

Gift card : means the document containing the offer, location, validity number, and where applicable validity date and description enabling you to benefit from an offer in a Millésime establishment, produced by the BIRD company, a limited liability company with a capital of €3,108,600, having its registered office at 28, rue Etienne Marcel – 75002 Paris, registered in the Paris Trade and Companies Register under number 789 176 187, registered in the Register of Travel and Holiday Operators under number IM75180053 with Atout France – 79-81, rue de Clichy – 75009 Paris, having as guarantor GROUPAMA ASSURANCE CREDIT & CAUTION, 8-10, rue d’Astorg – 75008 Paris, France, and as insurer ALLIANZ IARD, 1 cours Michelet, CS 30051 – 92076 Paris la Défense Cedex, France.

The Gift card may be issued by post or given by hand.

Gift box : means the box containing the Gift card, T&C, withdrawal form and any information documents, where applicable.

Establishment : means the Millésime establishment distributing the Gift card and Gift box / performing the Services, which collects money, issues invoices, monitors deliveries, checks the compliance of the Service and all the obligations referred to in the offer, subject to the reservations specified in these T&C.

Millésime : means all the Establishments that are part of the Millésime Group as stated on the website

Service : means the whole offer provided by the Establishment to the Beneficiary subject to availability of the Establishment on the dates selected by the Beneficiary.

Client : means the person who buys the Gift card / Gift box, on the understanding that the Client may or may not be the Beneficiary of the Service, depending on whether it is for his/her personal use or for another Beneficiary.

Party(ies) : means the Client and/or the Millésime Establishment concerned.

II . / General Terms and Conditions of sale and use

Purpose of T&C – Scope of application

These T&C apply to sales of Gift cards and Gift boxes, in Euros, in France and abroad, by Millésime.

They are published online, on the website and can be downloaded by the Client – DOWNLOAD HERE

They are sent by post, email or fax to any Client who requests them.

Placing an order implies full, unreserved acceptance by the Client of the T&C and, where applicable, shall prevail over any other condition, version or any other conflicting document. Any conflicting condition binding on the Client, unless expressly accepted, will not therefore be binding on Millésime, regardless of the time when it became aware of the said condition.

The Client acknowledges having read these T&C prior to entering into the contract and has accepted them fully and without reservation.

Every time an order is placed on the website, the Client must confirm their acceptance of the T&C by ticking the box provided. This acceptance is in no way conditional on a handwritten signature.

Acceptance of these T&C presupposes that the Client possesses the necessary legal capacity to agree to them. If the Client is a minor or does not have the said legal capacity, he or she acknowledges having permission from a guardian, administrator or legal representative.

Millésime reserves the right to amend and update these T&C at any time, on the understanding that the applicable T&C will be those in force on the date of final, unequivocal placing of the order by the Client and as formally accepted by the latter.

The Client acknowledges the evidential value of Millésime’s automatic back-up systems and, unless it can provide proof to the contrary, waives its right to contest them in the event of a dispute.

In accordance with the provisions of Article 1125 et seq. of the French Civil Code, these T&C may be saved on a computer and/or printed by the Client.

The fact that the Millésime Group does not avail itself, at a given time, of any one of the terms of these T&C may not be interpreted as a waiver of its right to avail itself of any one of the said terms at a later date.

The days expressed in these T&C are understood as calendar days.
